Preamble
FIOR & GENTZ Gesellschaft für Entwicklung und Vertrieb von orthopädietechnischen Systemen mbH (hereafter: FIOR & GENTZ) has high demands on the quality of its products and on the patient treatment. We would like to provide orthotists worldwide with techniques and products so that they can treat patients in an optimum way and at the highest level.
Not only our commercial products, but also the appearance to which our texts, graphics, photos and other data provided by FIOR & GENTZ belong, are part of the brand FIOR & GENTZ and are also subject to our high quality standards.
These Terms of Use guarantee a responsible handling of all copyrighted data in the interests of FIOR & GENTZ.
The following Terms of Use are in force for the copyrighted data which are provided by FIOR & GENTZ. By taking notice, at the latest with the use of images, graphics, texts and other copyrighted data of FIOR & GENTZ, the user accepts the following conditions:
1. Object of Use
The following conditions are in force for all data disclosed by FIOR & GENTZ. By “data” is meant: images, graphics, logos, texts, photos, videos and software programs.
2. Intended Use
The data are disclosed with one or several of the purposes stated below:
a) advertisement for FIOR & GENTZ products;
b) editorial reporting about FIOR & GENTZ and its products;
c) performance of services for FIOR & GENTZ e.g. consulting, production of promotional, packaging and selling materials, creation of web presence, performance of other services.
3. Rights of Exploitation/Obligations for the User
a) FIOR & GENTZ concedes elementary, free of charge rights of exploitation within the following conditions listed here.
b) Data is disclosed only for a singular usage of the concrete individual case in the sense of the intended use stated above and to the extent required to achieve this purpose.
c) The disclosure of the data to third parties is only allowed within the intended purpose and
- only with the aim of copying printed products;
- publishing of ready advertisement materials or press products;
- for production and publishing of homepages and televised reports.
It must be ensured that the third party deletes the provided data after the purpose has been achieved.
d) If the data user is a wholesaler, he/she undertakes to oblige his/her trade partner to compel with the Terms of Use. If the recipient of the wholesaler’s goods is himself/herself a reseller, the user undertakes to oblige his/her reseller to accept these Terms of Use as well.
e) FIOR & GENTZ may withdraw the transferred rights of exploitation for any or all data at any time and without giving reasons.
f) Obligation to Name Sources: If the data is used, a source reference (source: FIOR & GENTZ, Lüneburg) must be named. Furthermore, a link to the website of FIOR & GENTZ www.fior-gentz.com has to be set at a suitable place of the user’s website.
4. Restriction on Use
a) The data user undertakes to always use the latest photos, graphics, videos and texts or other copyrighted data of FIOR & GENTZ.
b) The use of data as information or promotion for products of the competitors of FIOR & GENTZ is not permitted.
c) It is not permitted to edit pictures, especially to modify them by copying, photographing or to change them in another way manually or digitally. Excluded from this is the enlargement or reduction of the images if there is no quality loss.
5. Obligation to Delete Data
a) Disclosed data must be deleted and its use must be immediately ceased if there is a violation of the provisions of the paragraphs 2, 3 or 4.
b) The user undertakes to discontinue the use of the data immediately if FIOR & GENTZ requests it or if an agreed period of use has expired.
6. Liability of FIOR & GENTZ and the User
a) The liability on the part of FIOR & GENTZ for direct or indirect damage from the use of the data is as far as legally permissible limited to the intent and gross negligence of its own employees or vicarious agents.
b) The user is obliged to release FIOR & GENTZ from claims of a third party resulting from the unauthorized use of data or the use contrary to these terms. The user is also obliged to compensate FIOR & GENTZ for any damage arising from the delayed removal or inappropriate presentation of data.
7. Place of Jurisdiction/Written Form
a) These Terms of Use as well as the usage of the disclosed data or products are governed by German law. Place of jurisdiction is Lüneburg.
b) Differing agreements have to be made in writing.
